Welcome to PositiveO. These Terms of Service help outline how our platform works and what you can expect from us. By using our website, mobile application, or services, you’re agreeing to these terms, which are here to protect you, our community, and our mission of providing accessible mental health support.
1. Acceptance of Terms
1.1 By using our services, you confirm that you are at least 18 years old or have parental/guardian consent to use our platform.
1.2 These Terms and Conditions form a legally binding agreement between you and PositiveO.
2. Our Services
2.1 PositiveO provides a digital mental health platform offering:
Access to forums (“Town Square”) for community engagement and support.
Connections to licensed counsellors and therapists for virtual sessions.
Self-help tools, resources, and educational content.
2.2 All features are subject to availability and may be updated at our discretion.
3. User Responsibilities
3.1 You agree to use our Platform for lawful purposes and in a manner consistent with community well-being.
3.2 You are responsible for the accuracy of information you provide and for maintaining the confidentiality of your account.
3.3 You must honour the anonymity and privacy of all users; do not share, speculate about, or attempt to uncover the real-world identity of other community members without their clear and voluntary consent. Note: This does not apply to voluntary sharing features like session feedback.
3.4 You must not harass, abuse, harm, or impersonate others; post illegal or harmful content; or attempt to disrupt the Platform’s functionality.
4. Privacy and Data Protection
4.1 Your privacy is paramount. Our comprehensive Privacy Policy details our practices.
Information We Collect: To operate effectively, we may collect personally identifiable information (name, contact details), profile data, log data (IP address, usage statistics), and information exchanged with your counsellor (“Information”).
Health-Related Data: Some Information you provide is considered sensitive health data. Providing it is voluntary, but certain Platform functions may require it.
Use of Information: We use your data to provide, personalise, and improve our services, and as described in our Privacy Policy. We employ significant thought, effort, and technical measures to protect it.
5. Counsellor-Client Relationship & Confidentiality
5.1 Confidentiality: All information shared during counselling sessions is considered privileged and confidential, forming the core of our trust-based service.
5.2 Limits to Confidentiality: Counsellors and PositiveO reserve the right to breach confidentiality where there is a reasonable belief of imminent risk of harm to yourself or others, or as required by law.
5.3 Clinical Judgment: Counsellors use professional evaluation tools and reserve the right to discontinue services if a user breaches these Terms or is deemed unsuitable for our platform level of care.
5.4 Referrals: This service is intended to aid in managing emotions and experiences. Your counsellor or PositiveO may refer you to specialised facilities or resources where necessary for your well-being.
6. Sessions & Cancellations
6.1 Scheduling: Sessions are scheduled via the Platform. You are responsible for attending at the agreed time.
6.2 Cancellation Policy: Repeated failure to attend scheduled sessions without prior notice may result in service cancellation. If you wish to re-engage, you may need to reapply and await approval and an available slot.
7. Intellectual Property
All content, designs, logos, and materials provided by PositiveO are our intellectual property. You may not copy, distribute, or exploit any part without our prior written consent.
8. Limitation of Liability
8.1 PositiveO is provided “as is.” We do not guarantee that the Platform will be uninterrupted or error-free.
8.2 Our Platform is NOT for medical emergencies. If you are in crisis, please use the emergency contacts listed on our Urgent Help page.
8.3 Counsellors are independent professionals. PositiveO is not liable for any advice, outcomes, or interactions in sessions.
9. Termination
We reserve the right to suspend or terminate your access immediately if you violate these Terms.
10. Changes to These Terms
We may update these Terms periodically. The “Last Updated” date will reflect changes. Continued use of our services constitutes acceptance of the updated terms.
11. Governing Law
PositiveO is a Pan-African platform based in Nigeria and South Africa. These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nigeria.
